1. Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of Shift@PennHousing (the “App”), developed and maintained by Andrew Chelimo (the “Developer”). By accessing or using the App, you agree to be bound by these Terms and by our privacy policy, which is incorporated by reference. If you do not agree, do not use the App.

The App is provided for the internal use of University of Pennsylvania Housing staff only. It is not available to the general public and is not distributed through the public Apple App Store or Google Play Store.

2. Eligibility and account access

Access to the App is limited to individuals authorized by Penn Housing management, including student workers, Service Managers, House Managers, Residential Services Managers, Building Administrators, and system administrators.

You must sign in using your University of Pennsylvania email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Your access to the App is tied to your staffing relationship with Penn Housing. Access may be suspended or terminated upon separation from that role, as described in Section 9.

3. Description of the service

Shift@PennHousing is an internal staff-scheduling and desk-coverage tool. It provides, among other things: viewing, claiming, dropping, and swapping shifts; automated coverage escalation (broadcast, float assignment, and, where enabled, contracted Allied coverage); submitting scheduling preferences and leave requests; receiving push notifications about shifts and required actions; manager tools for building, publishing, and administering schedules, including AI-assisted schedule generation; and a knowledge-base and Desk Assistant reference tool for on-desk procedures.

The App reflects real-world staffing decisions. Actions taken in the App, such as claiming a shift, acknowledging a float, or submitting a permanent transfer, have real operational consequences and may affect your actual work obligations and hours.

4. User responsibilities and acceptable use

You agree to use the App only for its intended purpose: coordinating and documenting your Penn Housing staffing responsibilities. You agree not to share your account credentials with any other person; misrepresent your availability, hours worked, or shift coverage; attempt to gain access to another user’s account, schedule, or personal information; attempt to circumvent scheduling rules, hours caps, or eligibility restrictions enforced by the App (including the Harnwell training-eligibility restriction); interfere with, disrupt, reverse-engineer, or attempt unauthorized access to the App’s infrastructure; or use the App to send abusive, harassing, or false communications to other users.

You are responsible for the accuracy of information you submit (preference submissions, break requests, contact information) and for promptly acknowledging time-sensitive notifications, including float assignments, as required by your role.

5. Manager and administrator responsibilities

If you hold an SM, HM, RSM, BM/BA, or Admin role, you additionally agree to use administrative privileges (schedule publishing, worker administration, override authority, force-triggering coverage escalation) only for legitimate staffing purposes; exercise cross-house administrative access, where granted, consistently with Penn Housing policy; and not use access to another worker’s personal information for any purpose outside your staffing-management duties.

6. Automated and AI-assisted features

The App includes automated systems that make scheduling determinations without direct human review at the moment of the decision, including automated shift-coverage escalation (broadcast, float lookup, and Allied-coverage routing) and reminder notifications.

The App includes an AI-assisted schedule-generation feature available to managers. AI-generated schedule proposals are suggestions only; a human manager reviews and must affirmatively publish a schedule before it takes effect. The Developer does not guarantee that AI-generated proposals are optimal, error-free, or fully compliant with every staffing rule, and managers remain responsible for reviewing proposals before publication.

The App includes a Desk Assistant knowledge-base reference tool. Responses are generated from a curated internal knowledge base and are provided for informational convenience only. They are not a substitute for official Penn Housing policy, your supervisor’s direction, or emergency procedures. In an emergency, follow official Penn Housing emergency protocols, not the Desk Assistant.

7. Intellectual property

The App, including its software, design, and underlying source code, is the property of the Developer and is protected by applicable intellectual property laws. These Terms do not grant you any ownership interest in the App. You retain no license to use the App outside the scope of your authorized Penn Housing staffing role, and your access does not extend beyond the period of that role.

8. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement.

The Developer does not warrant that the App will be uninterrupted, error-free, or fully secure, or that automated scheduling, coverage escalation, or AI-assisted features will produce error-free or optimal results. You acknowledge that scheduling systems can experience downtime, delayed notifications, or software defects, and that you are responsible for using reasonable judgment and, where appropriate, direct communication with your manager, in addition to relying on the App.

9. Suspension and termination

Your access to the App may be suspended or terminated by Penn Housing management or the Developer at any time, with or without notice, including upon separation from your Penn Housing staffing role, violation of these Terms, or misuse of the App.

Upon termination, your right to access the App ends immediately. Sections of these Terms that by their nature should survive termination, including Sections 7, 8, 10, and 11, will survive.

10. Limitation of liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of wages, hours, or scheduling opportunity, arising out of or related to your use of, or inability to use, the App, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law provisions, consistent with the App’s operation for University of Pennsylvania Housing.

12. Changes to these terms

The Developer may update these Terms from time to time. Material changes will be communicated through the App or through Penn Housing administration. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
